Agreement
By using OpenMyScan at openmyscan.com (the "Service"), you agree to these Terms of Use. If you do not agree, do not use the Service.
What OpenMyScan is
OpenMyScan is a browser-based viewer for DICOM medical imaging files. It is a software tool you use to open files that already belong to you. It is not a medical device, is not cleared or approved by the FDA, CE, or any other medical regulatory body, and does not provide medical advice, diagnosis, or treatment recommendations.
License to use
We grant you a worldwide, non-exclusive, non-transferable license to use OpenMyScan for personal, non-commercial viewing of your own medical imaging files, or files you are authorized to view (for example, a child's scan where you are the legal guardian).
Acceptable use
You agree not to:
- Use the Service to view imaging files you are not legally authorized to access
- Attempt to reverse-engineer or redistribute the Service
- Use the Service to provide medical advice, diagnosis, or treatment to third parties
No medical advice, no warranty
OpenMyScan is provided "as is" and "as available," without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
OpenMyScan does not interpret your scan, flag findings, or replace your doctor. If you are worried about something you see in your scan, consult a qualified medical professional. Reliance on images viewed through OpenMyScan is at your own risk.
Limitation of liability
To the fullest extent permitted by applicable law, OpenMyScan and its operators are not liable for indirect, incidental, consequential, or punitive damages arising from your use of the Service, including medical decisions made based on viewing your own scans, data loss, or service interruption. Total liability for any claim arising from the Service is limited to €100. Nothing in these Terms limits or excludes liability for gross negligence, intent, personal injury, or any liability that cannot be excluded under applicable law.
Your responsibilities
You are responsible for complying with laws that apply to your health information in your jurisdiction. If you share scan files with third parties using OpenMyScan's export or share-package features, you are responsible for the legality and appropriateness of that sharing.
Data and privacy
How OpenMyScan handles data is described in our Privacy Policy. Because the Service runs entirely in your browser, your DICOM files are not uploaded to our servers.
Changes to these terms
We may update these Terms of Use. The "Last updated" date at the top of this page will reflect the most recent change. Continued use of the Service after changes constitutes acceptance of the updated terms.
Governing law
These Terms are governed by the laws of Germany. Any disputes shall be subject to the exclusive jurisdiction of the German courts. Nothing in these Terms affects your statutory rights as a consumer under applicable law in your country of residence.
