Agreement

By using OpenMyScan at openmyscan.com (the "Service"), you agree to these Terms of Use. If you do not agree, do not use the Service.

What OpenMyScan is

OpenMyScan is a browser-based viewer for DICOM medical imaging files. It is a software tool you use to open files that already belong to you. It is not a medical device, is not cleared or approved by the FDA, CE, or any other medical regulatory body, and does not provide medical advice, diagnosis, or treatment recommendations.

License to use

We grant you a worldwide, non-exclusive, non-transferable license to use OpenMyScan for personal, non-commercial viewing of your own medical imaging files, or files you are authorized to view (for example, a child's scan where you are the legal guardian).

If you purchase Pro, the license extends to Pro features (PNG/JPEG export, share packages, compare mode) for the duration of your Pro term (3-month, yearly, or lifetime).

Acceptable use

You agree not to:

  • Use the Service to view imaging files you are not legally authorized to access
  • Attempt to reverse-engineer, redistribute, or resell the Service or any Pro features
  • Use the Service to provide medical advice, diagnosis, or treatment to third parties
  • Circumvent license validation or attempt to activate Pro without a valid purchase

Pro purchases

Pro subscriptions and one-time purchases are processed by Lemon Squeezy. Prices are displayed in USD and include applicable taxes as determined by Lemon Squeezy based on your billing location.

Refunds. We offer a 14-day refund window from the date of purchase, no questions asked. Email legal@openmyscan.com with your order number to request a refund.

Yearly subscription renewal. The yearly tier auto-renews each year unless canceled before the renewal date. You can cancel at any time through the Lemon Squeezy customer portal or by emailing us.

Lifetime license. The lifetime tier is a one-time purchase that grants access for as long as OpenMyScan continues to operate. If OpenMyScan is discontinued, we will provide reasonable notice and release the Pro-unlocked version for offline use where technically feasible.

No medical advice, no warranty

OpenMyScan is provided "as is" and "as available," without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

OpenMyScan does not interpret your scan, flag findings, or replace your doctor. If you are worried about something you see in your scan, consult a qualified medical professional. Reliance on images viewed through OpenMyScan is at your own risk.

Limitation of liability

To the fullest extent permitted by law, OpenMyScan and its operators are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service, including but not limited to medical decisions made based on viewing your own scans, data loss, or service interruption. Total liability for any claim arising from the Service is limited to the amount you have paid us in the 12 months preceding the claim.

Your responsibilities

You are responsible for complying with laws that apply to your health information in your jurisdiction. If you share scan files with third parties using OpenMyScan Pro's export or share-package features, you are responsible for the legality and appropriateness of that sharing.

Changes to these terms

We may update these Terms of Use. The "Last updated" date at the top of this page will reflect the most recent change. Continued use of the Service after changes constitutes acceptance of the updated terms.

Governing law

These terms are governed by the laws of Germany, without regard to conflict-of-law principles. Any disputes will be resolved in the courts of Berlin, Germany.
